Study On Evaluation Index System Of Law-based Business Environment

Optimizing business environment is the guarantee of deepening reform and opening up and driving high-quality development.Socialist market economy is essentially a law-based economy."Building a law-based business environment" is the key to optimize the business environment.Based on the incentive principle of "promoting construction by evaluation",the establishment of law-based business environment objectively requires the construction of an effective evaluation system,in which the index system determines the scientific nature of evaluation and occupies core position.The research on evaluation index system of law-based business environment is a new subject in interdisciplinary field spanning jurisprudence and public administration,involving multidisciplinary theoretical methods and value integration.Using the methods of text analysis,normative analysis,comparative analysis and empirical analysis,based on the relevant theories of law-based economy,government under law and evaluation of rule of law,according to the logic of "theoretical analysis-technical System-Empirical research-feedback suggestion",and on the basis of reviewing the practical experience of evaluation of rule of law at home and abroad,the construction of the evaluation index system of law-based business environment involves theoretical basis,concept definition,function orientation,path method and structural dimension to serve the evaluation purpose.Using the improved analytic hierarchy process,the index and its weight are determined by referring to the results of expert consultation survey,and the scientific nature of the index system is tested by empirical analysis,and further improvement suggestions are put forward.The main conclusions of this paper are as follows.Firstly,it integrates objective indicators,expert evaluation,enterprise satisfaction and public satisfaction.Including four first-level indicators of business legal environment,business law enforcement environment,business judicial environment and business law-abiding environment,13 second-level indicators and 50 third-level indicators,the evaluation of index system of law-based business environment is scientific and adaptable.Secondly,empirical research is carried out based on the former systems.The results show that the environment of business legal,law enforcement and law-abiding is "short board" of law-based business environment in Guangdong province,lagging behind the construction of law-based government and law-based society.Regional imbalance,relatively low satisfaction of the public are also due to the results.At the same time,law-based business environment is closely related to the level of economic development.Lastly,the validity of index system of law-based business environment is influenced by evaluation purpose,evaluation subject,data source,application of results and technical methods.Further optimization of the index system needs to match internal and external environmental conditions.The innovations of this paper are as follows.Firstly,the research involves in some important fields and focus on new problems.The construction of the index system is based on the unity of the value goal and the technical goal to meet the practical needs.Secondly,the research introduces the concept and method of government performance evaluation from the perspective of the third-party evaluation subject,reflecting the results-oriented and satisfaction-oriented ideas.Thirdly,the paper uses the improved analytic hierarchy process and carries out empirical research on a large scale,and reflects the index system with the results of empirical tests in order to realize the innovation of technological path.At the same time,due to subjective and objective reasons,there are still some shortcomings in the study of quantitative evaluation of law-based business environment,the application boundaries of subjective and objective indicators,the applicable conditions of index system and the construction of technical methods,which need to be further explored in the future.
