| In 2018,the National Development and Reform Commission promulgated the China Business Environment Report,and provinces have explored the construction of provincial business environment indicator systems.In recent years,China has attached importance to the construction of the rule of law business environment and the establishment of the corresponding indicator system,but the existing rule of law elements of the existing province-built business environment evaluation indicator system are insufficient to comprehensively and scientifically evaluate the rule of law business environment within the province,and the theoretical research on the rule of law indicator system at the provincial level is insufficient to provide a basis for practical construction.Therefore,it is necessary to study the construction of the evaluation index system of the rule of law business environment in provincial areas.In order to build a system of indicators for evaluating the rule of law business environment in provincial areas,it is necessary to first clarify the necessity and feasibility of building a system of indicators for the rule of law business environment in provincial areas,which is the premise and basis of the research.The logical mechanism for constructing a rule of law business environment indicator system by focusing on provincial areas is that the construction of a rule of law business environment is part of national governance,and provincial governance is a key level of national governance,so the construction of the indicator system should also focus on provincial areas.The construction of the indicator system is a requirement for comprehensively following the rule of law and promoting the rule of law in provincial governance,as well as a requirement for implementing the decision to optimism the business environment under the rule of law and promoting the economic development of each province,and is necessary.The theoretical research and practical experience of scholars in the connotation of rule of law,elements of rule of law evaluation and evaluation methods have also laid the theoretical and practical foundation for the construction of the indicator system,which is feasible.Secondly,the current state of construction of the provincial rule of law business environment indicator system is reviewed,and four shortcomings are summarized,namely,insufficient elements of the rule of law,incomplete content,inappropriate subjects and insufficient disclosure.The reasons for the shortcomings are insufficient understanding of the need for a business environment based on the rule of law,partial understanding of its connotation,inappropriate choice of the rule of law evaluation model and misunderstanding of the purpose of evaluation.Again,the reasons for the inadequacy of the existing indicator system are combined with the theory of constructing a rule of law evaluation indicator system,and the basic elements of the system are analyzed.Taking the meaning of the rule of law business environment evaluation index system as a logical starting point,we clarify the purpose of evaluation,select a suitable rule of law evaluation model,and thus select the appropriate subjects,evaluation objects,evaluation methods and pay attention to provincial characteristics,forming the overall idea of the construction of the index system.In other words,from the perspective of legislation,law enforcement,judiciary and law-abiding,we set "business regulations and policies environment","business law enforcement environment","business judicial environment" and "business law-abiding environment" vertically.The four primary indicators are "business environment for law-abiding",while the subjective indicators of enterprises’ perceptions and experts’ evaluations and the objective indicators are set horizontally.Finally,the preliminary index system is formed by combining the path of constructing the index system identified,and the content of the indicators at all levels is analyzed to provide a theoretical basis for the practice of the provincial rule of law business environment index system. |
