The Family Education Promotion Law of the People’s Republic of China is a promotional law to mobilize the whole society to do a good job in family education.Its introduction promoted the transformation of family education from "family rules" to "national laws",It has laid a legal foundation for the power to family education.The family education power is enjoyed by the parents alone as the parental power,then the parents transfer part of their educational power to the school under the background of socialized mass production,and then the family education power moves under the compulsory education system compulsion,and finally under the situation that the school education is in the dominant position,the family education power is bound by the school education power,and the family education seems to be reduced to the dependency of the school education.It is of great significance to guarantee and realize the power to family education from the perspective of constitutionalism and the rule of law theory or from the perspective of pedagogy and educational law theory.Foreign scholars started to study the power to family education earlier,and most of the relevant researches explored the concept of the power to family education and the theoretical basis of the power to family education from the perspective of law.Chinese scholars start to study the power of family education late and most of the related researches are based on the Angle of educational law.However,most scholars at home and abroad focus on the educational rights of families or parents,and there are relatively few researches on the educational power of families.This study comprehensively uses Denis Wrong’s Power Theory and Michel Foucault’s Micro Power Theory to construct the relationship,foundation and form of the power of family education.Then,based on the empirical study,from the demand of children for family education and the social requirements for family education,this paper analyzes the demands of parents for family education power,and puts forward the boundary between family education power and school education power.Finally,under the guidance of Max Weber’s ideal theory of social action,the author tries to construct the ideal form of family education power,respond to the social requirements of Chinese modernization,and realize the transcendence of reality.At the same time,with the support of literature review and realistic conditions,this paper tries to construct the path of the realization of family education power,and tries to clarify the responsibility of parents’ family education power and maintain the lost family education authority from the theoretical,historical and realistic perspectives.According to the above logic,this paper will be discussed from the following seven parts:The first part is the introduction,which mainly puts forward the question of the paper,the origin,purpose and significance of the research.The present situation of the research on family education power at home and abroad is summarized and the related concepts are defined.The research idea,method,theoretical basis,research contents,writing outline and possible innovation of this paper are determined.The first chapter analyzes the basic theory of family education power from the relation dimension of power.This paper mainly analyzes the nature and scope of family education power,and analyzes the rationality and legitimacy of family education power from the ethical ecology and legal basis.Through the above analysis,it is expected to clearly depict the internal relationship between family education power and family education rights,and structurally show the implicit family education power relationship.Chapter two analyzes the individual resource structure of family education power from the basic dimension of power.It mainly analyzes the personal resources(such as knowledge resources and example resources),organizational resources(such as organizational structure and organizational control)and the interdependent resources(such as information resources and relational resources)of family education power.The third chapter,starting from the formal dimension of power,analyzes the realistic representation of the operation of family education power.According to the idea of where power comes from,where power goes and how power is guaranteed,and from the dimension of historical change,the role of power and the survival needs of power,the comprehensive dynamic operation process of the migration,contents and legislative status of family education power are measured.Chapter four examines the family education power in the reality of the expression,demands and boundaries from an empirical perspective.It mainly analyzes the indicators and influencing factors of the exercise of family education power,the conflict and balance mechanism between family education power and state education power.That is to say,the cross-border behavior and the method of checks and balances between the family education power and the national education power in the exercise.It also analyzes the limitation and capability of family education power,the boundary of power and responsibility between family education power and school education power,and the value of family education power.In the fifth chapter,the ideal form of family education power is constructed from Weber’s ideal type,that is,the family education power with enlightenment value,no domination freedom,fairness and justice concept,which realizes the transcendence of reality.Based on the relevant research,this paper analyzes the path to realize the power of family education and committed to the maintenance of the lost family education power and the realization of the power of family education.The last part is the conclusion and thinking,which summarizes the theoretical basis of family education power,the resource structure of family education power,the form of implementation of the power of family education,the security strategy of the realization of the power of family education.It also makes a prospect for the development of family education power.
