Research On Legal System For Paroxysmal Water Pollution

In recent years, with the rapid development of economy, the paroxysmal water pollution events occurred frequently in our country, which not only made economic development and social stability become unstable, but also made people and their properties suffer more serious damages. While dealing with the paroxysmal water pollution, it seems that some problems appeared. The emergence of these problems is concerned with the imperfect legal system, such as lack of the law, unthougtful law provision and the law loose link. Since the pollution events happened in SONG HUA JIANG River in November, 2005, people has paid more attention to the legal system on how to deal with the problem of the paroxysmal water pollution. As a systematical guarantee of prevention and conduction of paroxysmal water pollution events, the emergency legal system of paroxysmal water pollution events has become a key component in emergency mechanisms of paroxysmal water pollution events in different countries. Therefore, the research of the legal system on dealing with the paroxysmal water pollution events has great theoretical and practical significance.This essay is composed of five parts: the introduction; the first chapter is an overview of the paroxysmal water pollution events in our country; the second chapter is the analysis of the legal system on paroxysmal water pollution events in our country; the third chapter is the lawmaking experience of other countries on meeting paroxysmal water pollution events and the enlightenment to China; the fourth chapter is perfecting our country's the legal system on meeting paroxysmal water pollution events.In the foreword, the paper introduces the problem of paroxysmal water pollution and the significance of the subject. In the first chapter, it defines the meaning, characteristics and classification. These fundamental concepts provide a theoretical basis for specific studies. In the second chapter, it finds out the shortage of our country's the legal system on meeting paroxysmal water pollution events from the Constitution and the environmental protection law. In the third chapter, it summaries the lawmaking experiences of other countries on meeting paroxysmal water pollution events, such as the United States, Japan, Russia etc. In the fourth chapter, it references the lawmaking experience of other countries on meeting paroxysmal water pollution events and make suggestions for perfecting our country's the legal system on meeting paroxysmal water pollution events.
