Study On Right Contents And Accomplish Route Of Chinese International Promotion Teacher

This dissertation is aimed at studying the Chinese international promotion(CIP) teachers' right contents and accomplish route which differ from the common teachers,advancing that regulate those fight and accomplish route in a legal way,establishing the foundation of legal system in managing Chinese international teachers.This dissertation completely organized CIP teachers' right contents and summarized it's characteristics;Investigated the realistic condition of what right have been enjoyed and what's lose in practice;Compared the international promotion teachers' fights between English and Japanese, and analyzed it's characteristics;Through the analyzing of case,revealed the fundamental fight appealing of CIP teacher,discussed the jurisprudence of fight enjoying.Thus,according to the realistic condition of right contents and accomplish route of CIP teacher,some initial suggestions for the improvement of CIP are raised.Through the studies we can know:No matter from the aspects of actual right enjoyment,or from the aspects of legal norm,the interest field of CIP teacher are too narrow,Additionally, together with the limitation of fight accomplish route,it is difficult to indemnify the CIP lawful fights and interests.In consequence of this,some initial approach for the improvement of CIP right contents and accomplish route as follow:(1)Harmonizing with The original work unit in human relations.With the Government Funded sending CIP teacher,in order to insure the original work relationship,we should perfect the separation form;establish the post recovery mechanism after they return to our country.(2) Joining for evaluation system of initial work unit.Establish the system of evaluation for the CIP,and join for the system of examination and evaluation of original work unit. (3) Joining for the wage treatment,welfare insurance of hanban.Establish the join mechanism for the initial work unit in wage treatment,welfare insurance,etc;consider the change in exchange rate and some basic work,life payment.(4) Complete the relief system of education law,reinforcing the safeguard function of embassy.
