The Study Of Seaman's Vocational Safeguard Legal System Of China

This article studies on Seaman's Vocational Safeguard Legal System (SVSLS) of China.It is our mission encountered at the beginning of new centenary to reform seaman's employment relations, the future SVSLS must serve the employment relations of new mode. Some predictions to the future SVSLS, are brought forth in this article, through the investigation and study into the national present SVSLS, and referring to the relative international conventions and the foreign legal system in such field.The future SVSLS, should ensure that, the seamen are at liberty to choose ships, the ship owners have the right to choose seamen. Thereupon, the future mode should have the functions of seamen's registration and management, seamen's vocational guidance, seamen's vocational recommendation, seamen's vocational training and seamen's labor service supply. The functions should be ensured through setting up special organizations and establishing operation regulations concerned. In this article, some conceptions and comments are made on the organizations' setting and the functions' defining and the operation regulations.The reform of the national SVSLS should proceed in an orderly way and step by step, there is still some distance to the idealized mode, also, this article provides some inter methods in the progress of the reform.
