Rural land is the most essential factor of agriculture. Rural land system is the most paramount system which influences the development of agriculture and rural economy, while rural land property rights system is the core of rural land system. Any country who wants its agriculture and rural economy to realize modernization, must have its rural land property rights system perfected first. The existing rural land property rights system in China presently has some defects. For example, the main body of the land ownership is not clear, the frame of the rural land property rights is not rational, the rural land property rights are not stable, and so on. These defects not only make Chinese peasantry can not become the real owner of rural land, but also make the collective ownership system of rural land can not be realized effectively. These questions have influenced the stable and sustainable development of agriculture and rural economy in China. In order to find out the effective realization form of the collective ownership system of rural land, people ir, the field ;f both theory and practice have made a lot of quest. But most of these quests focused on the reform of the using system of the rural land. Only minority were concerned with the definition of ownership of the rural land. Concerning the present situation of our country, this dissertation pays its attention closely to the development of agriculture and rural economy, and aims to quest ways and methods to establish a ruralland property rights system which adapts to the demand of the socialistic market economy.This dissertation consists of the following five sections:The first section is the forward, which includes problem-posing, the main thoughts and research methods. The author points out that only by putting agriculture into the whole social economy system, seeking for resolutions from the interrelation among agriculture and other social economy sectors, can we get better resolutions to overcome the defects of the current rural land property rights system of China. Establishing a rural land property rights system that adapts to the demand of the socialistic market economy is bound to become the emphasis of rural land system's reform. The main thoughts of this dissertation: By analyzing China's current rural land property rights system's defect and its negative influences, viewing other country's and district's experiences and lessons, this dissertation aims to carry on a innovative study on the rural land property rights system. The research methods are the combination of standardized analysis with concrete analysis, and quantitative with qualitative.The second section analyzes the basic theory about modem land property rights system. This section consists of four parts. First, by analyzing the connotation, characteristics, function and transaction of property rights, the author deems that property rights is a batch of rights and it has its own characteristics and function, and the property rights system which we chose depends on the cost of transaction. Second, the thesis analyzes land property rights and its framework in brief, and then concludes that land property rights is a summation of different rights, it is based on the land ownership and focused on the land usufruct. It is composed of ownership, usufruct, proceeds right, treatment right and so on. The third part is the definition of the land property rights system and the demand of the modern land property rights system. Finally, the authorsummarizes the evolutional trend of the modem land property rights system briefly.The third section analyzes the states of the representative country's land property rights system. At first, the author analyzes the states of the land property rights system in Japan, Denmark and our Taiwan district respectively, and then propounds a few instructive revelations.The fourth section introduces the condition of the rural land property rights system in country of China.
