Research On Conditions Of Realizing Chinese Rule Of Law

By tracing the origin and the development of the theory of rule of law, this article educes the concept of it and generalizes the becoming conditions that is market economy, civil society, democracy and rational consciousness, then probes into the conditions on which China will reach a rule-of-law country based on the analysis.In Chapter One, the article demonstrates the inevitability for our country to radicate the political strategy of "Establishing a socialist country ruled by law" through generalizing the lesson in construction of rule of law after new China-establishing and the fact that reform and open-door practice drives and calls for rule of law.In Chapter Two, starting with the turning from planned economy to market economy and the inherent association^ between market economy and rule of law, the article discusses the economic condition for rule of law in our country, points out that the socialist market economy should be more completed so that a strong economic base for rule of law can be established.In Chapter Three, the article first discusses the development and concept of civil society and the intrinsic relations between civil society and rule of law, then figures that to provide a realistic social base for rule of law our country should positively foster civil society and pushes it becoming, finally suggests realizing this goal by innovation of social system and social policy.In Chapter Four, the article proves the combination of politics democratization and legalization builds a institutional base for rule of law, conciders after analyzing the situation of Chinese democracy construction that our country should positively and safely carry through political system reformation, push the politics democratization and legalization with following measures that is separating party from the government, improving System of People's Congress, strengthening democratic supervision and reformation of judicial system .In Chapter Five, the article discusses the function of legal consciousness, points out the rationalization of legal consciousness is the cultural condition of rule of law. For there are some contradictions between the reality and rule of law, some measures to solve them are be provided.The conclusion is that our country cannot but achieve a nation and society of rule of law with the construction of market economy, the becoming of citizen society, development of democracy and rationalization of citizens' legal consciousness.
