On The System Of Administrative Openness

The system of administrative openness established since WW II is one of the important administrative procedure system. This dissertation covers four parts. The first part is the basic theories of the administrative openness system, probing into its connotation,the bases of constitutionalism, the bases of theory of law and the realistic bases. The second one is the valuable perspective of the system. The third part is the comparative study of the foreign system of administrative openness. By comparatively analyzing the foreign countries' large administrative openness pattern and the small one in the aspects of living envionment, openness' object, contents and procedure, a developing direction in the future is the small administrative openness pattern tending to the large one. The forth one analyzes the status quo, achievements, defects and their reasons of China's administrative openness system. On this basis, the thinking of perfecting China's administrative openness system is put forward, i.e. realize the system's legalization, democratization and modernization, deal with the relationship between the system and national secrets, commercial secrets and personal privacy. The concrete measures of perfecting the thought are to establish fundamental right's status of the right of know, rebuild the system's basic contents, strengthen its outer guarantee mechanism.
