The political law theory is a very tiny sub branch in political science that is: Politics→ Political science→ the modernization of political science →the legalization of political science→political law theory. Thin is a gradual division from the general theory to divided specific theory then it generates some sub branches at political science, and there are also divisions within each sub branches, ex, the political modernization is a subdivision of political science. Therefore, political science voluntarily develop in to a deeper stage. To follow this tide of the dividing politics, and considering the political legalization the important sector of political modernization, we need to subdivide the political law theory form it, to sustain a systematic specific study of political legalization in order to enhance the study of political law theory, we need know the political law theory is the logical result of the continuous division of political science.The political law theory is the study of political law, the study itself objectively makes the basis of value of political law theory, and the complexity of political relations determines the diversity of political law, and it also requires a diversified political law. But the current studies mostly focus an the importance and the establishment of independent laws, although there are some insights, there need more profound works being done. We need systematic study in this field. The previous study had provided legal and scientific foundation for political law theory. And the macro-environment of "administrating nation by law " has provide a necessary outer condition for the development of it. The importance, necessity, and possibility of the theory has full manifested its innate logics.The political law are laws that regulates the political relations, therefore, law and the science of law are the basis of it, and we need to make use of the general principle of law and science of law. The construction of political law is the union of many forces. There's strong need to use advantages and legislative resources rationally, to make fulluse of the advantages of the law institutions. And at the same time, the political law is about political relations, therefore, the rules should be in accordance with the political theory. But the concerned institutions are more capable of the political rules and general theory. Nowadays, the scope of science of law concentrated on the improving and accomplishing the system of law in their studies of political law study. And the scope of politics had focused on the political legalization the innate relationship among the political law and politics, and political operation had revealed that scope of political science should be "the 3rd scout" in the construction of political legalization. There is need of the full use of the political principles in the construction, also the specialty and systematic studies should be mad in political law. And the key role of it lies in the practice of political law, and the study of law is also important.
