Sea Area Utilization Management Law Study

Nowadays, in the great trend of world economic globalization, as man has developed ocean rapidly and got huge economic efficiency, the world is stepping into the new era of studying, developing and protecting the ocean. Simultaneously, China is facing both opportunity and challenge in the ocean comprehensive management area. As a big ocean country, it is a great pity that, so far, China has made merely very little study of basic theory of the sea area legislation, division and utilization management.The author has made a deep clarification and study of the basic concept and theory of China' s sea area utilization management law, by mainly adopting the research method of comparative analysis. The article has had a detailed analysis of the legislation present condition of China' s sea area utilization management law, by taking sea area utilization management law as theme and China' s sea area management law as the main object of study, by analyzing China' s sea area present condition, by taking sea area management law as a main guidance and by combining the legislation and practice of various countries. The article has put forward such a suggestion that will carry out sea area division in accordance with the characteristics of China' s different sea areas, realize preferential disposition of the economic value of various sea areas, protect the continued development of China' s ocean economy, look forward to the future of China' s sea area utilization management law and enforce sea area utilization management law.
