A Study Of Chinese Nature Reserve Law System

Natural resources and environment are the basic material prerequisites of people' s survival and advancing of social development. Not only contradictory elements but also harmony exist between people and nature. People need to remake nature rationally and effectively protect nature for the sake of self existence and multiplication. It is a great beginning that people create nature reserves in order to protect ecological system, wildlife, nature relics and increasingly serious environmental problems. Nature reserves are the superior formation in nature protection. It is also an important base of developing nature protection. Up to the late 2002, 1757 various nature reserves were built all over China, covering 133,000,000 hectares, taking 13.2% of land. Among them there are 188 national-level nature reserves that reach international level. However, legislation of our nature reserves is rather stagnant. National-level law system of nature reserves is composed of one administrative law, five department regulations and some documents with department rules. District law of nature reserves is similar to the miniature of national legislation. It is urgent to enhance nature reserve legislation, build perfect nature reserve law system which is suitable to Chinese national conditions. Beginning from the current development of our nature reserves and law system of reserves, I analyzed Chinese legislation system of nature reserves, used the experience and developing tendency of other countries of law system of nature reserves for reference and proposed suggestions of improving law system of nature reserves. The suggestions are as follows: accelerate making basic nature reserve law?Nature Reserve Law> correctly understand the meaning of "one district, one law" ; enhance drawing up relative administrative laws and department rules; increasingly enact local regulations and local government rules, thereby build perfect nature reserve law system.
