AbstractNature reserve (NR) is one of important pioneering works of recent human over ever-increasing aggravation of environment and the protection on the ecological system, wildlife. and nature relic. It is the supreme protection model over nature. And the important base for protecting nature as well. There is 1276 NR in China until the year of 2000, which covered 12.44% area of the territory and reaches the international standard. However, the legislation on NR is lagging behind that the state level legislation contains only the Byelaw for NR. 3 Management Measure and some law like regulations and documents. The local legislation is a little similar the state's. It cannot be neglected the shortages of the local and state legislation on NR. As the result, the urgent affair to develop NR is to strengthen law system meeting the situation of China.. The study begins with development actuality of NR and the legislation of NR, and puts forward the urgent problems of NR's legislation by assessing the legislative actuality and referring some developed experiences and the developing tendency of oversea NR's legislation. And it builds up the NR legislative system meeting the situations of NR fundamental laws (the Nature Reserve law), intensifying the layout laws and strengthening the NR protections made by all relative ministries and commissions in the State Council and local state.
