A Study On The Construction Of The System Of Chinese Resources Security Law

With vast explosion of population and fast development of economy & society, resources supply aren't meeting increasing resources demand, which brings about the problem of resources security. Resources security refers to the acquirement of the natural resources, of a country or a district, sustainably, stably, duly, adequately, economically, in particular time, under a specific economical and technological condition with a good maintenance toward the natural resources and ecological environment indispensable to human beings' survival. Presently, China is being confronted with a severe situation of resources security, which many related scholars have been discussing and studying, and have got a lot of constructive suggestions. However, in these studies, there are few studies on the issue from legal aspect. Therefore, in this article, the author deliberately and systematically studies the issue of construction of the system of Chinese resources security law, expecting it could make up for the research gap on the issue, and provide a few theory support or guide for the construction of the system of Chinese resources security law.In the article, the author discusses the origin, connotation, types, influence factors, basic situation and protection system of resources security, and analyses the current situation of resources security law protection in China, and expounds the necessity of construction of law protection system on resources security in China, and points out the logic starting point of construction of law protection system on resources security in China, and studies the guide thinking, basic principle, object and fundamental avenues of construction of law protection system on resources security in China, finally briefly states the main content of construction of law protection system on resources security in China.After a cautious study, the author holds that China should make a thorough research on resources security relations which the system of Chinese resources security law is logically based on, then according to the entity principles including resources sovereignty, resources fairness, resources co-operation, broadening source and reducing consumption, considering both safety and interests, putting prevention first, appropriate intervention of the government and participation of the public ,and the method principles consisting of the combination of practice and theory, of subjective and objective conditions, of principle and flexibility, of stability, continuance andchangeability according to times, of summarizing, learning and scientific prediction, construct the system of Chinese resources security law under the guidance of the theory of sustainable development. By clearing up old laws, enacting new ones, and concluding or entering international treaties, we should complete the construction of the system of resources security law in China composed of all laws and regulations concerning resources right security, resources exploitation security, resources trade security, resources transportation security, resources reserve security, resources processing & utilization security, resources science & technology security, resources crisis management and resources security superintendence, of which the basic law is resources security law or natural resources law (containing the primary rules of resources security law), in which domestic laws are in harmony with international laws, procedural laws are integrated with material laws and laws, statutes and administrative regulations cooperate.
