On The Perfection Of Information Disclosure System In Food Safety Regulation

Food safety information disclosure system is an important link in food safety regulation, which is helpful to transparency, publication and improves the consumer's confidence. Food safety information asymmetry is one of the important reasons that results to food incidents. In order to reduce losses arising from information asymmetry, all governments pay more attention to the importance of information disclosure system. By analyzing the theory of information asymmetry, this thesis, focusing on the consumer's right to know, social responsibility of corporate and civil collateral duty, elaborates the legislation of China's current food safety information disclosure system and points out the defects of the current system ,then puts forward some suggestions that how to improve China's food safety information disclosure system.The thesis consists of four parts:Part I defines the important concepts, that is, food safety regulation, food safety information and food safety information disclosure system.Partâ…¡analyses the reason why food safety information disclosure system exists from the economic and law science aspect, in order to provide theoretical support for improvement of the food safety disclosure. This part declares that, to see from the perspective of economic, it is necessary for a perfect food safety information disclosure system to solve food safety information asymmetric problem. To see from the perspective of law science, current food safety information disclosure system is to protect the consumers'right, demonstrate the social responsibility of corporate and require for civil collateral duty.Partâ…¢points out the defects of current food safety information disclosure system. This section starts with two disclosure bodies that are government and food companies, analyzing the deficiency of the information disclosure for government, foods manufacturer and marketing enterprise. Meanwhile, according to this part, owing to lack of relevant laws, the information disclosure system is still imperfect.Partâ…£puts forward some legal suggestions for the food safety information disclosure system. This part is a key of this article. At first, this part elaborates the general idea of completing the food safety information disclosure and points the way of the concrete measure below. Then, this section focus on the imperfect aspects discussed in part two and makes some comparation and analysis between developed countries. At last, the writer proposed five resolutions, which match with the realities of our country, from the aspects of the information disclosure system, food safety information traceability, food label, food safety information releasing channel and relevant law of information disclosure system.
