People started to concern about food safety monitoring system after several major food safety incidents. In the area of food safety monitoring system, the conflicts between departments, triggered by different departmental interests, are becoming more serious, e.g.: the overlapping and the absence of government functions. Solving the conflict problem between the government departments is the key point to rationalize the food safety monitoring system. Shanghai and Shenzhen has carried on the reforms of food safety monitoring system earlier than other cities. Shanghai, as the pilot city of the reform, has made innovations and experimentations over the past few years, which is particularly worthy for other provinces and cities to learn.This essay tried to research on the successful food safety monitoring system both abroad and domestic, and made bold assumption for the model selection of our own system in the future, in order to find a proper way of food safety monitoring in matching with the China's reality. Apart from the preface, this article contains three major parts as follow:Chapter One:â… emphasized that one of the legislative intents of is to rationalize the food safety monitoring system. Starting with the "Sanlu milk powder incident",â… pointed out the major monitoring loopholes under the current system. Thenâ… reviewed the four important reformations after the implementation of the in 1995, and elaborated the food safety monitoring system established in , revealing the current food safety regulatory framework roundly from both the horizontal angle and the vertical angle.Chapter Two:â… mainly analysed the contributing factors of the conflicts between departments.â… also elaborated several obstacles during the process of food safety monitoring, including the lack of uniformity and compatibility of the legal basis in law enforcement, the unclearness of the jurisdiction in law enforcement, the superfluousness of the law-enforcing departments, the departmental interests above the public interests in law enforcement. And all of the discussion above has paved the way for the following system design.Chapter Three:â… described the regulatory reformations in Shanghai, Shenzhen and Wuhan, summed up the experiences and lessons during the reformations. And I also outlined the regulatory systems in some developed countries like USA and the European countries.â… concluded that we should learn from the successful experience of foreign countries during the construction of our own food safety monitoring system. On the base of the descriptions and analysis of the current problems in our food safety monitoring system,â… suggested that we should choose a progressive and unified monitoring system of the reformation. In addition, in order to ensure the final realization of the progressive and unified monitoring system, on one hand we should define the status and power of the monitoring organization from three levels including constitution and aw, administrative regulations and regulations of ministry. On the other hand, we should ensure the authority of the food safety committee as a high-level coordinating institution.This article has covered a hot and difficult problem in food safety monitoring area. And it is a new exploration to apply an aggressive and unified monitoring system in food safety monitoring area. Research methods used in this article included historical and logical method, case analysis method, comparative method, and administrative law theory and related method.
