Study On The Application Of The Government Contracting-out In Youth Affairs

Ever since the Procurement Law of the People's Republic which firstly addressed Government purchases, both the central and local governments have implemented a series of regulations.In recent years,based on these pioneering and successful explorations, our legislations on Government purchases have developed into a relatively complete and all-around system in a short period of time. As a new idea,system and method of providing public service by government,government contracting-out has been used widely by all levels of Chinese local government in many fields of social public service,especially in Youth Affairs, in the recent years which has turned to be an important approach for government gradually to raise the level of public service.But, government contracting-out is still a new option in China, the related legislations are inevitably with certain flaws. Especially with the increasing of the government contracting-out in youth affairs lately, the issue once again became under the spotlight. Accordingly, the urgency and necessity of establishing and perfecting our legal system on government contracting -out recall is rising. This dissertation is aiming at doing a thorough study on the status of government contracting-out of youth affairs, finding out the deficiencies of the present legislation and legal enforcement and putting forward suggestions on government contracting-out of youth affairs which suits China's reality, referencing successful experiences from overseas. The dissertation is divided into three parts:Capter one :Government to buy the legal analysis of public services. Starting with the introducing the idea of government contracting-out ,reviewing the historic background and theory of government contracting-out,the article analyzes the experience, The behavior rule of government contracting-out is also discussed based on the research and analysis of behavior elements and behavior modes.At the same time, by analyzing the behavior of the government to buy elements of public services and purchase of principle, to further clarify the features and functionality of the system.Capter two : the Government contracting-out in Youth Affairs. This chapter gave readers a birds'eye view on the existing domestic legislations on the Government contracting-out in Youth Affairs,in full recognition of their theoretical and practical significance,at the same time,conbine with the actual situation,proposing the range and purchase of the object which is bought by the government suitly.And it also showed the way and the processes the government use.Fianlly,I introduce you the practical results in Shanghai and Hongkong.Capter three:Youth services of the Government to purchase the existing problems and recommendations. this chapter analyzed the profoundness of speeding up perfecting our legal system and gave out several suggestions.And put forward many proposals for the inadequacies of existing law.
