China's Legal System Of Imported Food Recall

With the rapid development of international food trade, large quantities of Imported food are entering our country. We are Facing more and more new issues of food safety. As China's food recall system itself and the related systems of food itself are imperfect, the special nature of the particularity of the main food recall and other reasons, to further establish and improve mechanisms of imported food recall is the urgent need for the reality.It is learned that China imported food each year from more than 140 countries and regions. In general terms,the overall situation of the quality of imported food is good,but still there are some food safety hazards. Unsafe imported food are more frequent exposured and even some well-known international brands popular.Imported food is the subject of food recall system ,its recall fully is applicable to the food recall system, imported food recall system and security bases on food recall system. section 42 of " Food Recall regulations" is made of imported food recall in general terms. August 19, 2010 the State Administration of Quality Supervision on Food Security Act made additional provision, published the "Import and Export Food Safety Management Regulations", further defined the responsibilities of our main imported food recall and expanded the range recall of imported food .Local laws and regulations on imported food recall system did not clear and specific provisions, but imported food recall system in many parts of provinces in China have been implemented earlier.There are many constraints in Establishment and improvement of imported food recall: for example, the poor understanding of business concepts; laws and regulations about imported food recall are imperfect; imported food traceability system is imperfect; cross-section management monitoring system; imported food recall needing safety standards system is not perfect. Overcome these factors, the system needs a long-term efforts.According to the perspective of our current legislation, the obligations of food recall in China should be identified as the main food producers. However, further supplementary provisions of "the import and export food safety management measures," made clear that the responsibility of China's imports of food products subject to recall is importer. With the "Food Safety Law", the main subjiect of food recall was a clear, its responsibility is more clarity.According to China's "food recall regulations" and related academic research , China's food recall programs can be divided into four steps: development food recall plan to start food recall, the implementation of product recall, food recall evaluation and supervision . Imported food can be recalled on the three steps above. Food importers shall bear other legal responsibility after performancing of the obligation to recall in any way.In order to establish and improve the imported food recall system, large discusses can be discriped in the following aspects: (a) Give full play to the consumer's role in food recall; (b) Broaden the scope of "unsafe food" recall; (c) Clear recall the main responsibility for imported food; (d) Further reform of supporting rules and regulations; (e) Improve the quality and safety of imported food traceability system; (f) The establishment of enterprise credit system in imported food trading; (g) The establishment of insurance system of product recall liability; (h) Pay attention to communication and cooperation.between food-producing countries and import countries.
