| Legal assistance ensures the legal interest and rights of the citizen and equality before the law at the same time its significance ranges from the legal justice to the realization of social stability and harmony. Yet legal assistance in China is still in the primary stage, present law, institution and measures do not well match the actual need and demand, which hamper the sustainable development of the legal assistance in China. With the modes of legal assistance provision as a point of departure, present study analyses the modes of provision in China andproposes suggestions on how to better the legal assistance.Present study has over 22000 words, which consists of four parts excluding introduction :Part one thoroughly analyses different modes of legal assistance provision. The analysis of the legal assistance practiced in China and the comparison with those in some western countries, this part also illustrate the roles of the western modes that have played in China.Part two points out the problems exist in the provision mode of legal assistance in China, which analyzed from the aspects of the undefined roles of the legal assistance providers , funding and the quality of the cases.Part three attempts to find out the reasons and causes of the problems that exist in the legal assistance in China.This part emphases and illustrates the sensitive issues such as an incomprehensive legislation of legal assistance, the unclear boundary between government responsibility and the obligation of the lawyers and the provision of the funding and management.The fourth part proposes that legislative reforms should be enhanced for a higher level of legislation, specialization of legislation, comprehensive content of legislation. At the same time, institutional building- up should be promoted including cooperative mode, human resource, mode of service, source of funding and managerial and monitory mechanism of personnel, funding and facility.
