Research On Legislative Issues Related To Administration Planning

As an important way of modern administration, administration planning is playing an increasingly important role in the administrative process of the country. At present, administrative planning legislation is not perfect in China. Which has resulted in administration planning lacks of necessary legal-restraint, and consequently, the executive abuse of administrative planning and administrative violations of the legitimate rights and interests of the administrative relative happens frequently in practice. In view of this, the author selects the problem for this study.Firstly, from the needs of this essay, the author defines the concept and nature of administration planning. And then, the author analyzes the legislative status of administration planning, finds out the problems of current administrative planning legislation. Including the legislative philosophy of administration planning is behind, the basic principles of administration planning is miss, the process of administration planning lacks of public participation and abstract administration planning lacks of judicial relief. Finally, aiming at these problems, the author study how to complete administration planning's legislation from structuring progressive legislative-philosophy of administration planning, establishing basic principles of administration planning, ensuring public participation in administrative planning procedures and improving judicial relief of abstract administration planning and other aspects.
