As China's steady economic growth, the construction of democratic politics is furthering in depth. At the meantime, there is also growing emphasis on the protection of people's democratic rights. As the basic organization for building of democratic politics, village committee election is the key. Moreover, the village committee elections is the crucial way for people to exercise their democratic rights as a villager. Therefore, maintaining a good management of the village committee elections is the premise and foundation to ensure the exercise of democratic rights of villagers.However, in reality, vote-buying behavior, which corrupts the village committee election campaigns occurs continuously; and such phenomenon tends to spread rapidly, which will seriously hamper the development of rural democracy. Based on the discuss of the phenomenon mentioned above, this paper aims to define the nature of vote-buying, and thereby to analyze capable methods to avoid the crime of interfering with election. As the beginning, it will cognize vote-buying from the conception, nature, and essence of such behavior. Based on such recognition, it will then analyze the elements as well as the danger of vote-buying in virtue of the development of criminal law, as the in-depth qualitative research on act. Finally, it will reach the conclusion that: vote-buying, which seriously destructs the village committee elections, should be treated as a crime- the crime of interfering with election. Furthermore, it will continue to discuss the adjusting range and the perfection of the crime regulation, from the perspective of criminal justice policy. In sum, such discuss is for the purpose of keeping criminal law's modernity, providing criminal law protection to village committee election, and ensuring a more favorable construction of rural healthy development of democratic politics.
