In absorption of domestic and international theories connected with theright to education in law and education and benefiting research results in suchrelevant disciplines as sociology, political science, etc, this article carries onpreliminary research and demonstration about the right to education inontology, value in theory and motion in theory, using method of historyinvestigating synthetically and value analysis synthetically. The whole contentis consisted of preface, text and conclusion.In preface, the thesis demonstrates the significance of researching theright to education in theory and practice. The right to education is a basichuman right written in <> andaccepted by countries in the world. However, the research of human rights isstill immature both at home and abroad.In text, the thesis regards ontology as its view and analysis the basicvalue. the right to education and concludes the right system of the right toeducation, then it regards the value in theory as its view and elaborates thevalue of the right to education; last the thesis regards the motion in theory asits view and proposes how to achieve the right to education .Part one, the basic natures of the right to education. The right toeducation is observed in international human rights acts, regional human rightsacts and constitution systems of various countries. The basic natures of theright to education have three levels. Firstly, the right to education is a right ofhuman being. Secondly, it is a basic right written into the constitution. Finallyit is a right compounded with freedom right and social right.Part two, the right system of the right to education. It is a conclusionabout the content of the right to education. The content can be divided intothree phase rights according to sequence that it occurs and develops. The firstis a right to opportunity of education in initial stage; the second is a right tocondition of education in course stage; the third is a right to appraise ofeducation in final stage. Three rights are linked organically, making up anintact system of the right to education. Every right respectively includesseveral sub rights.Part three, the basic value of the right to education. Education can impelthe interpersonal equality. Meanwhile equality is the goal of education. Firstly,it introduces the development course of equality in the right to education inthis content. It clears the meaning of the right to education. Then the articleexpounds manifestation of the right to education in substantive law, mainlyexplaining from equality of subject and content. Equality in chance toeducation requires that all school should be open to everyone, everyone hasthe chance to receive education. Equality in education condition requires thateducational resources, such as educational facilities, teachers'strength shouldbe balanced according to counting per capita. Equality in education appraiserequires that the appraise should obey the objective standard.Part four, guarantee of the right to education .In the basis of summarizingguarantee system of the right to education in our country, the thesis putsforward my own suggestion about the guarantee of right to education. Theguarantee system is firmly consisted of the guarantee of legislature,administrative organ and judicial authority.
