In regard to the judicial mechanism of the international organization that has already had now, the mechanism of dispute solution of GATT/ WTO is not only characteristic but also remarkable. The mechanism of dispute solution of GATT emerged from practice. It was regulated by legislation further and became the procedural regulation of the solution of the international trade dispute that is reasonable and practicable finally. On the base of taking after the mechanism of dispute solution of GATT, DSU have the breakthrough development, mainly reflecting on performing the compulsive jurisdiction of panel, judicatory independence and strictly ruling on each link and procedure limit etc. DSU further carry through the aim of guaranteeing the development of trade and economy of the developing country of WTO, consumedly increased preferential treatment to the developing country, from the panel's composing, secretary's special job to the consultation, panel's procedure, justify of carry out the procedure and the etc. In many ways the developing countries are given the special treatment. Using them, the developing countries can defend their benefit better. At the past half century, the developing countries, such as Brazil, India, Cuba and the etc, have used the mechanism of dispute solution of GATT/ WTO and protect their benefit. But the fact is that it is hard for the developing countries use the special treatment to defend their benefit because of the weak place of the developing countries and the problem of DSU. On the base of acknowledging that DSU is advanced and reasonable, we should realize the problem of the developing countries how to attend and use DSU. This article will systematically study the mechanism of dispute solution of GATT/ WTO and its related provision of preferential treatment to the developing countries and the practice of the developing countries and have the conclude that the developing countries should joint their effort on several aspects in order to make DSU become the useful means of the developing countries. This study is significant to developing countries including China.
