Influences And Countermeasures Of Performing CITES With China's Entry Into WTO

In this article, the status of wildlife import/export and supervision in China was analyzed, and the data from the government department was analyzed and compared. On this basis, some problems were found that existed in wildlife import/export and supervision so that pointed out the importance to research on how to improve the level of wildlife import/export management after access to World Trade Organization (WTO).It made a summarize about the basic condition, final aims, basic regulations and limitations of WTO and those of Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). Based on that, a analysis was made for the possible conflicts between WTO and CITES through the comparison of some typical cases about wildlife trade. It suggests that the regulations and policies associated with environment and trades, the regulation of "the latter excelling the former" and "the especial excelling the normal", and the "exceptive" regulation can be used to unpuzzle and avoid the conflicts.From the viewpoint of performing CITES, it is illustrated in this article that the rights we can take and the responsibilities we must take after access to WTO. It is also summarized the opportunities and advantages the WTO brings to us. The access to WTO is of great benefits to the performance of CITES in our country, such as reforming the mechanism of wildlife management, the problem-solving of the protectionism in wildlife trading by developed countries and adjusting the policies of wildlife trading in our country, and dealing with wildlife trading issues through active actions, etc.Some problems, which would be encountered in the future in spite of the existence of the opportunity, were analyzed recollectedly. It was emphasized that the primary problem of the performance of CITES is the incomplete law; the resplendent and centuries-old Chinese traditional medicine industry would be in face of the most severe threaten; along with the actualization of "trade liberalization", it should also be recognized that the conflict between wildlife protection and utilization will get more vehement; and the adjustment and change of policy due to joining in WTO could have negative impacts on various industries.As to the problems we might meet in the performance of CITES after China successful access to WTO, a series of feasible advise are raised in this article with the consideration of the regulations of sustainable development, on the management of performing CITES, etc: to perfect the laws and regulations, to carry out the wildlife and its products marking, to enhance the investigation of performance after joining in WTO, to enhance the investigation of sustainable resource utilization of Chinese traditional medicine, to list the species that cannot be protected effectively in our country into CITES appendicitis to protect them, to promote the construction of the system of wildlife import/export management, to enhance the supervision of wildlife import/export, and to grip the chance, exploit the international market energetically, and supplement the resource in our country. It is mentionable that the comparison of the laws related to wildlife import/export in Australia, U.S., and the Europe brings three further advices: what the wildlife management legislation should mention in our country in the future, how to exploit the international market energetically in the future, and how to supplement the resource in our country using the resource abroad. They offer an idea of the management of wildlife import/export in our country after joining in WTO.
