Research On The Law System Of China's Historical Cities Protection

To protect the historical cities is to protect the environment; therefore China's historical cities are not only the embodiment of China's excellent national culture, but also an important part of our living surroundings. However, we have destroyed some part of historical cities, thus having destroyed our living surroundings during the construction and development of cities. Therefore, research on the law system of the China's historical cities protection has a significant role in protecting the environment. In the course of research, this thesis makes a definition on the concept of historical cities, combs the system of China's historical cities protection and puts forward the corresponding countermeasures on perfecting the law system of China's historical cities protection by adopting such methods as historical analysis, jurisprudential analysis, comparative analysis, systematic analysis, etc. on the basis of the theories of environmental protection law. This thesis consists of five parts.Part one is the general analysis of historical cities protection, which mainly puts emphasis on the fundamental theories and states that the historical cities protection is the gradually deep-going result of cultural heritage protection, that the concept of the historical cities should be used and the corresponding concepts among historical cities, historical counties and historical villages should come into being so as to construct the system of historical heritage protection, and that historical cities protection has the positive significance in fulfilling the environmental entire function and value, guaranteeing the continuance of historical culture, developing the tourism resources effectively and developing the planned city construction.Part two deals with the evolution on the law system of China's historical cities protection. This part, mainly using the historical analysis, holds that the international charter as well as the corresponding law systems on the world cultural heritage protection has a direct effect on the establishment of the law system of China's historical cities protection, and that China had announced in 1982 the first 24 historical cities, which signifies the initial establishment of the law system of China's historical cities protection considering the fact that some part of the historical cities have been seriously destroyed in China's economic development.Part three analyzes the status quo of the law system of China's historical cities protection.
