Corruption is an ulcer in the economic and political life of human society. It threatens national stability, undermines social justice and severely endangers social tranquility and sustainable development. With the advancement of the economic globalization, corruption, which is called "the gray plague", becomes more and more rampant and has developed into the biggest bane with common recognition by the international community. Therefore, combating corruption becomes the rising concern of both the international community and all the nations in the world. As the acclimation to the tide of anticorruption, the United Nations formulates and passes the UN Convention against Corruption that lays a solid legal foundation for the international efforts to fight corruption and promote international cooperation in this field. As a State Party to the Convention, China's legislation must response to the Convention, especially the criminal legislation. Out of such consideration, I choose this subject to fulfill my dissertation.Beginning with the definition of corruption and the crime of corruption, the dissertation illustrates the background, the significance and the contents of the Convention, based on the systematic summary of the international legislations before the formulation of the Convention. In the following parts, the dissertation compares the Criminal Law and the Criminal procedure Law with the Convention to highlight the differences. On the basis of such analysis, the dissertation puts forward the modification suggestions, which I hope to be beneficial to the perfection of the legislation in the field of anticorruption.
