The Study On The Value Of The Circular Economic Law

The question of value is a issue which the legal science cannot avoid. The research on the value of the circular economic law will guide people to shift their cognition about the circular rules and regulations from experience to ration, that is, the value field, and then reflect the orient, scope and depth of the development of the circular law. Moreover, it will promulgate the social demand degree of the law and the law's effectiveness degree in the social practice.This paper studies the value of the circular economic law for the purpose of promulgating the situation that the existence, the nature and the activity of the law as the object of the value, satisfy the needs and the goals of the people as the body of the value. The paper first analyzes the concept of the value of the circular economic law, and then points out that it is the relationship reflection between the body and the object, which has subjective and objective attribute, and appears as the intrinsic value and the external value. Next, in the goal value latitude, the paper promulgates and elaborates the various goals value of the circular economic law, i.e. multiple-goal value of the proper attention to both environmental justice and economic efficiency, and the coordination of environmental security and economic liberty; On the base of above research, this paper finally discusses the realization of the value and analyzes the barriers in the realization process by pondering measures to solve this issue. It proposes that people should establish the basic principle system including the sustainable development principle, the frugal principle, the risk prevention principle and the social responsibility principle, and construct the basic institutional framework including the scientifically planning system, the clean productive system, the green expense system and so on.
