Biodiversity is that the combination of all kinds of live organism in certaindistrict. It generalizes the equilibrium regulation of nature ecosystem. Nowadaysbiodiversity conservation can give mankind three important values that is economicvalue, ecosystem value and humanities value. With the social development, we cansay conserving biodiversity is protecting mankind oneself. So the international societywants to establish the effective legal system. The international legal documents suchas "Convention on International Trade in Endangered Species of Wild Fauna andFlora", "Convention on Biological Diversity", "Cartagena Protocol Biosafety"embody the international concerns. Although there are some deficiencies in theconventions, they provide the legal samples for the world. And many countries enactlaws to conserve the biodiversity.China is rich in biodiversity due to its complicated natural conditions and thebiodiversity plays a very important role in building and improving global ecologicalenvironment. However, China's biodiversity has suffered heavy losses resulting fromhuman population growth, economic development and environmental pollution aswell as ecological destructions. Confronting the losses of natural resources, theChinese government has been taking a series of measures. Among them our countryestablishes the legal system of biodiversity conservation preliminarily by enactingsome laws.It's well known to all law is the most important and effective method ofbiodiversity conservation. However, the current laws about biodiversity can't satisfythe social requests. Furthermore there are many problems in the law enforcement.Therefore, this thesis analyzes the different legal conditions of biodiversityconservation among international society, developed countries and China, andproposes our country should establish the perfect legal system of biodiversityconservation and implement the international conventions effectively in order tosatisfy the demand of biodiversity conservation in market economy system.
