On The Corporate Environmental Responsibility And Its Implementation Mechanism

Corporate production behavior is one of the most important causes thatlead to environmental problem. The key point to solve environmentalproblem is to burden corporations with the legal obligation on environmentalprotection and promote its carrying out. It is a practical need and also anoutcome of a series of social conceptions transform. Especially the theory oncorporate social responsibility is booming and developing, which affordstrong support to undertake the environmental responsibility for corporations.So choosing the theme of corporate environmental responsibility andstudying how to promote its implementation is the subject of this thesis. The concept of corporate environmental responsibility is defined in thesense of "primary obligation" in this paper. The concept implies that in thecourse of production corporations should observe environmental law andmaintain the environment interests. It modifies previous theory of corporatepurpose and emphasizes significance of maintaining the environmentinterests. Meanwhile, this concept shows that corporate environmentalresponsibility is a legal duty, but not a punitive provision.On the background of developing cleaner production and advancing theimplementation of cleaner production law, this paper analyzes the charactersof corporate environmental responsibility in cleaner production law and thedilemma encountered during the course of its applying. Then the paper pointsout that we should concern law function's changing from unity to multiple,intensify the functions of law on education, inducement, and interestenhancing. Moreover it brings forward the thoughts of exercising theintegrated regulating mechanism to promote corporations to fulfill theirenvironmental responsibility. Based on the above, corresponding legalsystems should be built from different sides, such as economic incentivemechanism, non-powered administration mechanism, self-controlledmechanism and social regulating mechanism and so on.All the mechanisms we mentioned emphasis differently but affect andinteract with each other. And they embody the superiority of integratedregulating mechanism in promoting the implement of corporateenvironmental responsibility.
