The Construction Of Tourist Law System In Our Country Under WTO Frame

Tourist industry has already become a fast developing and prospective new industry in the world. Which plays an important role in the world economy. Since the 1990s, the tourist industry gets rapid development and becomes one of the greatest industry in the world. After the reform and opening-up, the tourist industry has achieved great developments, and occupied great proportion in our economy. However, the legal system concerned with tourism still falls behind. Although the related governments have set up some concerned tourist laws and documents, which have contributed greatly to our tourist developments, construction of tourist law has some lagging. After China joins WTO, it is necessary to consider how to deal with such problems in the field of tourist market. The resolution will necessarily profits trades abroad and realization of tourist powerful country and enforce the position in overseas trade system. The tourist industry must abide by WTO rules and perform promise of further opening-up, deal with properly trade friction, clear up tourist developing barriers, and realize gradually freedom of tourist trade. Just under such background, we should strengthen law construction in our country, tourist law coordinated with WTO in our country.From the introduction of this service areas with tourism, based on the "General Agreement on Trade in Services" (GATS) market Access, ofWTO non-discriminatory treatment, the principle of transparency in the field of tourism, as well as our Specific commitment and Horizontal of commitment, the author elaborated the tourism trade in services under GATS in WTO, as well as situation in our tourism. From three levels of national interoperability laws, the State Council Administrative rules and regulations, local rules and regulations, this article outlined the current status of tourism law enforcement and explored more details and from aspect of the tourism enforcement, law enforcement authority and administrative enforcement. Author in-depth analyzed the problems of tourism legislation, and law enforcement and the solutions in the existing system of laws and regulations;Author elaborated the theoretical basis of our tourism legal system coordinated with WTO. It also proposed tourist law system frame based on "Basic Law tourism," a leading role "travel agents Law," "guides Law," "Hotel Law," "tourism contract law", "Tourism Consumer Protection Law," and other single law and local regulations for supporting, trying to construct tentative plan coordinated with WTO system from the angles of legislation and law-enforcement.
