Says to some extent that environmental problem is a kind of unreasonable social result of reasonable behavior that personal pursuit for self-benefit. Mankind is affecting and reforming the environment of the earth all-directionally with the aid of science and technology fast developed. The contradiction of mankind and environment is unprecedented intensifying which threatening human survival and development seriously. Therefore people have to, sending hope to government, expect outside force intervene. For 2004 years the storm of environmental protection that national environmental protection bureau raised straightly finger for lawbreaking behavior in EIA coursed by more than 30 state-owned enterprises, including San-Xia power stations. In the 3rd plenary session of the 10th National People's Congress that convened in March 2005, premier Wen jia-bao promised in government working report: To let people eat clean water and breathe fresh air. As the embodiment of democratic concept in environmental affairs, the public participate in EIA have the meaning that cannot be replaced.Starting with the theory of EIA at the influence of sustainable development, this paper introduced the concept; nature and guarantee that affect its effective enforcement of EIA, then led public participate into text as one of guarantee.
