The various labor laws of different countries stipulate different system of worker participation, and present different results in the actual operation.The German pattern equates the labor force and the capital. It is designed as below: The shareholders and the workers select the certain proportion the representatives separately to form the board of supervisors, which is the surveillance institution of the enterprise, and the leading body of the board of the directors. The trustees appointed by the board of supervisors form the board of directors which is responsible for the decision-making and the service execution, but it does not undertake the surveillance function。The character of the Swedish model is that the laborer can share the stocks in enterprises, which authorizes the workers to have the right to share the capital by the collective way. In fact it is a kind of restriction to the ownership of the private capital.Enlightened by Germany, Sweden and Holland, South Africa established her own pattern, named workplace forums, according to her special situation. In South Africa, the domestic situation is in turmoil all the time, the relationship between labors and employers is in a tense state for a long time, strikes take place here and there, the racial discrimination caused by social contradiction is unusually sharp, and the economy of South Africa keeps depressing. However, the international economy is developing fast, global economic integration has caused the enormous pressure to the economic development of South Africa. How to make the productivity improve is a serious problem that the South African government has to face to. A representative of employers in South Africa said that'the democratization of the workplace is an absolute necessity if South Africa is going to compete globally—worker management relations have to be viewed and understood as a true partnership—not one in kind.'In according with such idea, legislators have founded workplace forums with South Africa's special.This text introduces the legislation and the practice of the workplace forums in South Africa, and analyses the deficiency of them. The system of worker participation triggers a lot of scholars who major in labor law or company law to study, the research on this system of the developed countries is quite extensive, but the study on the developing countries'is still new, we have a lot of work to do.
