The Dilemma Of The Owner Committee System And Its Solution

Home Owners Association is an autonomous organization to safeguard the rights and interests of all owners and a permanent body of owners' congress.In theory,Home Owners Association represents the owners,plays the role of safeguarding the public interests of all owners,has the right to supervise the daily activities of property service enterprises,and can also conduct litigation activities on behalf of the owners.However,the owner committee will encounter many obstacles in the actual operation process.In the process of setting up and running of the Home Owners Association,the behavior of property companies,government departments,neighborhood committees and owners and the system of Home Owners Association itself may be the factors that affect the normal operation of the organization.The solution of the dilemma of the Home Owners Association has become an important issue of academic concern.Firstly,through the investigation of the establishment and operation process of the Home Owners Association of a district in Shandong Province,combined with the demonstration of relevant literature,this paper reveals the problems encountered by the Home Owners Association,and explains the establishment stage and the daily operation stage of the Home Owners Association separately.In the establishment stage,the main resistance comes from the external main obstacles to the establishment of the Home Owners Association.In the daily operation stage,the system design,personnel quality,property management and many other aspects of the industry committee itself will be highlighted,making the operation of the industry committee difficult to sustain.From the perspective of the theory of condominium ownership and the need of property management,this paper further analyses the internal and external causes of the Home Owners Association's dilemma.For internal reasons,there are some defects in its own structure,personnel and funds;for external reasons,there are overlaps and conflicts between the industry committee and the owners,property,residential committees,government and other subjects,which make it difficult for the Home Owners Association to run smoothly.In fact,the obstacles caused by these reasons can be solved.Based on the analysis of the dilemma faced by the Home Owners Association and its causes,this paper proposes a way to solve the problem of the management of Home Owners Association in order to give full play to the role of the Home Owners Association as owners' self-governing organizations,enhance the level of community governance,and enhance the owners' sense of identity with the industrial committees and residential: 1.Toclarify the legal status of the Home Owners Association and ensure the smooth protection of owners' rights.2.The government maintains the autonomy of community autonomy and refines the main responsibility.3.Communication and supervision between Home Owners Association and neighborhood committee and property are institutionalized to ensure efficiency and mutual supervision.4.Improve the long-term development mechanism of the Home Owners Association through its own construction.5.Enhancing the enthusiasm of owners to participate in community affairs...
