Review On Gansu Tourism Legislation

Adhere to the principle of "ruling the tourism by law" is a guiding ideology of the National Tourism Development during the "11th Five-year Plan" period. Using legal means to protect and promote the development of tourism accords with the requirement of modern society ruled by law. The perfection of tourism legal system building is the prerequisite and guarantee for "ruling the tourism by law". The tourism legal system building includes the national legal system building and the local tourism legal system building. With the development of tourism in mangy places, numerous local tourism law have been promulgated in order to guide, standardize and safeguard the sound development of local tourism industry, the local tourism legal system building is gradually perfect. But compared with the trend of rapid development of the tourism industry, both the national tourism legislation and the local tourism legislation are obviously backward. It is necessary to further strengthen China s tourism legislation.The paper emphatically studies Gansu tourism legislation. The paper firstly analyses the history and the status quo of Gansu tourism legislation, discovers the problem existing in legislation, then puts forward some suggestion to perfect Gansu tourism legislation. The paper is divided into three chapters. The first chapter is the summarization of tourism legislation, including four sections, section I firstly discusses the current situation and defect of the national tourism legislation in order to understand the overall situation of the national tourism legislation, then analyses the relationship between the national tourism legislation and the local tourism legislation. Section II is the realistic foundation of Gansu tourism legislation, briefly analyzes the present situation and problems of Gansu tourism. The present situation of Gansu tourism is the foundation of Gansu tourism legislation, also the foundation of local tourism legislative study. Section III is the history and status quo of Gansu tourism legislation. Section IV compares Gansu tourism legislation with other places tourism legislation, summarizes the characteristics of Gansu tourism legislation. On the basis of chapter one, chapter two discusses the problems existing in Gansu tourism legislation, including two aspects, one is the defect of Gansu tourism legislation, the other is the reason of Gansu backward tourism legislation. In the chapter three puts forward some suggestion to perfect Gansu tourism legislation, including the significance of perfecting Gansu tourism legislation and the suggestion of perfecting Gansu tourism legislation in order to make clear the necessary of perfecting Gansu tourism legislation, then puts forward some suggestion from three aspects to perfect Gansu tourism legislation, including legislative idea, legislative content and legislative procedure.
