This paper clarifies the situation of "mobile population for college entrance examination" through data and facts and presents the serious problems in the -area of higher education recourse distribution on the basis of the thorough analysis of its social, cultural, political and school elements. "Mobile population for college entrance examination" means examinees transfer or transfer their registered permanent residence to change their former status as students for the areas where the marks are low and the rates of entering college are higher so that they will increase the chance of matriculation. "Mobile population for college entrance examination" can be classified into two types, which are legal ones and illegal ones. The former ones include those examinees who move to the areas where the marks are low for the need of their parents' job transferences. In this situation, mobile parents and examinees don't harbor the motivation of going to the low marks areas. It also includes those who translate their so that their children can take college entrance examination in low marks areas. The later ones include those examinees who enter for the examination in their permanent residence but also in low marks areas through illegal ways. Illegal examinees can also be classified into two types: one is those who have no local registered permanent residence enter for the examination in local place through illegal ways; another one is those who not only enter for the examination in local place but also in the low marks area, so that if they fail to enter for the examination, they can take it in original place."Mobile population for college entrance examination" is characterized by mobilization, speculation and obtaining the support of the government. At present, people make negative estimation to this phenomenon, whileâ… consider it more sensible. To a large degree, this phenomenon arises not from educators, educates or natural courses but from the lose, faultiness and morbidity of education policies and relative laws, systems and mechanisms. Form policy perspective, while taking actions on "mobile population for college entrance examination", the government should ensure equity and justness according to Constitution and Educational Law. From jurisprudence perspective, this phenomenon is with legality and rationality. According to jurisprudence, a student is a citizen, principal part of education. He should have the equal rights to receive higher education and choose colleges. For rationality, mobilization is the self-help action. Now, educational administrative department has taken improper actions. It is necessary the reflect education policies, government's administrative actions and education distribution. This paper tries to do creative research on "mobile population for college entrance examination" from jurisprudence perspective trying to make break through, and put forward the solution.At present, some improvement should be done in treating this problem by the government with proper measures. It is necessary to solve this problem in a new way. Firstly, correct the policies and actions of the government; secondly, examine the administrative actions of the government; thirdly, improve the laws; fourthly, narrow down the gaps of the marks between different areas and distribute educational resources properly; and finally, renew educational ideas and emphasize the idea of lifelong education.
