Pondering Over The Contracted Public Security Management On The Perspective Of Administrative Law

The contracted public security management means a new social security management mode, which the operations such as road patrol, crime prevention and public order management in a certain area or street are rewardfully commissioned to a certain person or a private organization by contract.It is a positive experiment and successful cooperation towards the efficient governance of public security, conducted by both government and private, as it has created the concept of multi-subject in the field of public security management, and improved its efficiency and function as well. However, it might breach the principle "Administration According to Law", which is regarded as one of the basic principles of administrative law, because of lack of the legal authorization; also, there are still some other problems when it carried out in practice.In this case, on the perspective of administrative law, the author try to discuss how to improve and perfect this management mode, by axiological and pragmatic research, from some aspects such as the range of contracting operations, competency and qualification of contractant, contracting procedure, evaluation system and measures to supervise, etc, so that it can operate and function efficiently, meanwhile, try to find a way on how to perform a good interaction between the government and private, and offer some helpful ideas to achieve our objective in the process of "Governance According to law".
