With the high-speed development of non-public ownership system economy, lots of contradictions in non-public ownership system labor relations appear day by day. Compared with traditional Planned-economic labor relations, there are many obvious characters in non-public ownership system labor relations. There are many obvious problems now, such as sighing inappropriate or no labor contract, low-wage , bad safe and health labor protecting condition, incompletely social insurance system, difficultly conducting consultations on an equal footing and signing collective contracts, difficultly solving labor disputes.There are many reasons coursing contradictions in non-public ownership system labor relations. Analyzing from the legal plane, the main reason is slow movement of labor legislation, so trade union as the representative for the interest of workers in labor relations almost lost the important position in the coordination system of labor relations, that is also incomplete in non-public ownership system labor relations, and the function of trade union don't become realization. The legal reasons of expiration of trade union are various aspects, including there are not strong punishment regulations in Trade Union Law, there are not legal protection for Collective Contract System, it is backward of legislation on the system of workers and staff'right of democratic management, there are not effective legal protection for trade union labor law supervision, there are not strong support for trade union safeguarding worker and staff'rights, there are many difficulties in trade union participating the coordination of labor disputes.In view of the fact of the non-public ownership system labor relations, it is urgent to improve the legislation of labor relations, and make law become more important to protect the adjusting of labor relations, and constructing the system of labor relations coordination in which the trade union is most important. The main contents include following parts, such as consummation the law and regulation of organizing Trade Union, Enhancement the law and regulation of collective contracts, advancing legislation on workers and staff democratic management, consummation the system of trade union labor law supervision, Strengthening the construction of necessary law and regulation in labor relations, advancing the construction of the legal system of the tripartite consultation mechanism, consummating the system of settlement of the labor disputes, then a complete legal and labor relations coordination system ,which the trade union is most important ,will become true.
