The Civil Servant Institution is a complicated and organic system consisting of legal management system, democratic supervision system, reasonable metabolic system etc. Among them, supervision and restriction system plays a safegarding role in the right execution of national laws, rules and policies and in the lawful, uncorrupted and effective administration of government-worked employees.In 2005, Civil Servant Law of PRC (Civil Servant Law) was just issued, which demonstrated the gradual maturation of the combination of The Civil Servant Institution's theory and practice. It regularized the management of civil servants, ensured their rights and adjusted to requirements of establishment of legalized society. As one of the important components, supervision and restriction system has been perfected accordingly, being a Civil Servant means more legal obligation and responsibility. Since personnel administration of leaders in our country has problems like "high promotion, low management and poor supervision", with no good supervision method, no fluent channel, which leads poor supervision and opens short cut for those few civil servant who are poor on self-discipline. Finally corruption could not been controlled thoroughly.The thesis is divided into four parts.The first part is the introduction of the relevant theory and practical significance of civil servant's supervision and restriction mechanism, mainly including theory of humanity hypothesis, power and supervision etc.The second part represents the current situation of the civil servant supervision and restriction mechanism in our country. It points out the fields where newly issued Law of PRC (Civil Servant Law) have perfected, and the short-coming remains unresolved. The author also analyze the Punishment Mechanism, Accountability Mechanism and Obviation Mechanism respectively, find out their deficiency and try to use current theory to analyze and solve the reflected problems.The third part is the enlightenment of the successful cases of this mechanism in some developed countries. Through the study of mechanisms in these typical countries, we can obtain some experience to guide the perfection of the supervision and restriction mechanism of Chinese civil servant system and to avoid disadvantages that already dug out. This analysis is in the following order of description: the Punishment Mechanism, Accountability Mechanism and Obviation Mechanism.The forth part is the conclusion, which includes some suggestions on the improvement and perfection of the Punishment Mechanism, Accountability Mechanism and Obviation Mechanism with reference to the successful experience and theoretical and practical analysis. Also the author brings out some methods regarding the innovation of civil servant's supervision and restriction mechanism in the network era, including setting up government supervision website, improving service function of supervision, accelerating the opening-up of governmental affairs and full use of network consensus.
