On The Lawful Protectction Of The Rights Of Teachers In Universities And Colleges

The legal rights of teachers in universities and colleges should be emphasized and protected, which is essential for the building of the legal system. With the reform of higher education system furthered, the management of universities and colleges and educational administrative departments gradually has got on the track of law administration and the notions of " restrict rights and protect rights" and "respect teachers and emphasize education" have won popular support. But in the process of the management of universities and colleges and educational administrative departments, unlawful conduct remains, which inevitably does some damage to the rights of teachers. The legislation of lawful protection of the rights of teachers in universities and colleges being incomplete in our country, teachers' rights damaged cannot be lawfully and equally redressed. This greatly thwarts teachers' enthusiasm and creativeness and hence affects the teaching quality and the training of high-quality talents. Consequently it is of great practical significance and theoretical value to discuss and study lawful protection of the rights of teachers in universities and colleges.Based on the analysis of the legal rights of teachers in universities and colleges, this paper mainly selects, analyzes and examines the rights that are subject to attack in practice, i.e. status protection right, democratic management participation right, material treatment protection right, rights of personnel and professional title evaluation, redressment right after legal rights are damaged and other issues arousing public attention. In addition, making use of relevant research results in the academic field for reference and drawing on the beneficial experience of legislative practice, some proposals for practically protecting the legal rights of teachers in universities and colleges and completing the system of lawful protection and redressment of the rights of teachers in universities and colleges are tentatively put forward. It is expected that these proposals can help in perfecting the legislation of lawful protection of the rights of teachers in universities and colleges.
