| As the continuous development of economy, many different ways of employment appear which contribute to both the economy and the employment market. However, because of the lack of experience on the labour market and the ineffective management, we are facing many troubles these have caused. Employing through human resource agency is a topical one among them. In order to regulate our country's employment market which is based on the employment contract, we started to implement Law on Employment Contract in our country. The law is built through many rounds of auditing and considered opinions of people from different areas in the society. It shows our solid decision to manage labour market and to improve the relationship between employers and employees.Law on Employment Contract aims at building a steady employment relationship and protecting employees rights. It appears as the development of the society and the economy. Comparing to former employment laws, it is more creative and has many breakthroughs. It gives more detailed instructions and regulations on range of use, responsibilities, save deposit, agent contract, etc. This makes parties involved have to readjust their policies to suit to the new law.The work dispatch, which is mainly characterized as separated hiring and leasing, is new and emphasised in new Law on Employment Contract. In recent years, as a new way of employment, Agent Contract is welcomed by employers because of its flexibility. However, as there were no formal regulations to guide this kind of contract in the country, Agent Contract had been misused by many companies and left its original principle. Therefore, Employees'rights were violated and a sustained hiring relationship was also affected.In this paper, I will analyze both advantages and the disadvantages of Human Resource Agent Contract from its background, origination, and development in our country and comes to a conclusion of current problems and related reasons in these kinds of contracts. In addition, my paper also explores different parties'responsibilities involved in the Human Resource Agent Contract according to the new Law on Employment Contract. Finally, the paper will include government in this new style hiring relationship to make Human Resource Agent Contract become a"tetrad"corporation. The objective is to regulate and guide this new kind of hiring relationship which will in return to facilitate the development of the society and the economy. |
