Analysis Of Farmers' Awareness Of Law In The Background Of Building A New Countryside

The rule of law and building a socialist country ruled by law is our party's objective in the new era.China is a large agricultural country with the populationof 1300000000,which accounted for 80 percent of farmers.Farmers enhance the awareness of the law means that the nation's heightened awareness of the law.If the farmers do not raise the legal awareness of the law,China's building a socialist country ruled by law will not be able to.Building a new socialist countryside is a major strategic plan which is from implementing the scientific concept of development and building a socialist harmonious society.Building a new socialist countryside is also a major issue of strategic initiative to solve the "rural areas,agriculture,farmers" problems.The building of a new socialist countryside puts forward some new demands on the construction of the rural development,for example,the construction of the rural development should ensure the agriculture as the foundation of the national economy.The building of a new socialist countryside can also provide a wide range community-based for the legal system,such as the basis of economy,political foundation and the basis of culture.At present, China's legal system in rural area and farmer's awareness of the law is still in a very low level.In rural area,the disputes of personal injures, property damages,land acquisition,contract,neighborhood and marriage are very common,but few farmers want to resolve disputes through litigation.Farmers have lost the confidence in the administration and justice.Although our country has already introduced many national documents to reduce the costs of litigation,the process is still very complicated.The laws have a security force from the country,but few farmers want to resolve disputes through litigation.The farmers are willing to compromise,by which their rights can not be effectively protected.In my article,the meaning and its features of farmers' awareness of law are analyzed,including the jurisprudence and legal history analysis.I compared the Chinese legal tradition and Western natural law theory, especially Western classical natural law theory.Then I chose Duntou town Haian county Nantong city Jiangsu province as the regional survey. I distributed questionnaires to the farmers to grasp the present situation of the farmers' awareness of law.In my questionnaires,there are ten problems.From the answers,I analyzed the real problem which is that the farmers are lack of awareness of the rights.The way to resolve the problem is to hold the flag of rights.Then,I analyzed some issues which are concerned by the farmers,for instance,the problems of the rural land contract rights,the urban-rural income gap,the village self-stimulation mechanism,rural disputes settlement mechanism.Finally,I explore some ways to enhance the farmers' awareness of the law.I indicated that we should perfect the legislation in rural areas.Only by a fair administration of justice and administration can win the broad masses of peasants to respect the authority of the law and strengthen the confidence of farmers of the law.Legal supervision is the achievement of a just judicial administration according to law and an important guarantee for it.Correct law popularization,including a good choice of law popularization of the content,timing,methods,is an important way to achieve good results in law popularization.Only in this way,farmers can gradually raise their awareness of the law,and the rule of law can gradually be achieved.
