Study On Some Leyal Questions About Union

As the improvement of China's economic system reform and the establishment the socialist market economy, particularly since the Second Plenary Session of the 16th Committee put forward to deepening the system of enterprise property rights, the rank of the working class has a new connotation, Non-public enterprises have a rapid development, economic construction has made great achievements. At the same time, the legitimate rights and interests of the labors have been constantly violated, Emergency matter,Petition matter happened frequently, it is a urgent need for labor union to actively carry out duty of protecting rights and play its role of the representative of interests and defenders of labors. The basic duty of protecting rights, which is decided by the nature and characteristics of the labor union.This paper based on defining the basic duty of the labor union, and analyzed the difficulties in safeguarding the worker'right by the labor union. It found out some causes of the plight: part of the local governments' misconduct; labor's unity rights cannot be effectively protected; shortcomings in the legislation and institution of the labor union. The paper gave some corresponding countermeasures and suggestions to deal with the plight of the labor union's safeguarding works : the Government should establish the correct concept of the "labor rights" ; labor union should take effective measures to safeguard the unity rights of labors; to improve the mechanism for dealing with labor disputes; to ensure the autonomy of labor unions in economic and administrative matters ; to strengthen the functions of collective bargaining of labor union, through legislation to protect the rights of labor unions and so on.
