The concept of difference before Rawls made the difference pri nciple is prevailing in the West and China,and the root has a lon g history.The thesis as a theoretical starting point,from a legal point of American scholars interpret the difference principle of Raw ls proposed,its theory and analysis the historical status of the syst em,trying to be applied to the field of Law.At the theoretical aspects of our Jurisprudence on the difference the introduction of th e concept of community has an important revelation.In fact,the process of modernization in the rule of law,formal equality and norms in the face of truth there is inadequate from the perspective of jurisprudence to define the "difference principle "is exactly the ti me.In practice,since the reform and opening of the disparity of wealth in our society,not only significant on aspects of their soc iety with the protection of the rights of vulnerable groups of practi cal but also the polarization of the society as a diagnosis of chroni c illness.Rawls's difference principle is propsed in the background that t he United States has the gap between the rich and the poor,totalita rian and serious social crisis of the right.He criticised Utilitarianis m to ignore the difference of people.He putted forward its own logic that inherited the distributive justice theory and the classical t heory of social contract.China exists a variety of differences.incom e differences,differences between rural and urban areas,different t reatment between different groups,and even different design of the system.We can analyze the theoretical and practical difference by th e historical and comparative methods.Although exsiting the differenc es between the United States and China,exsiting differences betwee n now and the past,we can get the theory that conform China's nati onal conditions,we hope that theory will have great significance.
