The Research Of The Application Of Rules Of Origin In WTO Framework

With the development of international trade and economic globalization, the role of agreement on rules of origin is increasingly important and wildly used in areas such as anti-dumping, anti-subsidy and anti-circumvention, especially in economic powers, such as America and EU.As a result, when we are dealing with complex international economic affairs, it is indispensable for us to make full use of some reasonable regulations to protect our interests and to oppose irrational request issued by other countries.The essay take the recent suit named"Measures that China inflicts on the import of the spare parts of automobile"as an example which issued by America and EU to China, to analyse the application of rules of origin in WTO framework.The first part of the article introduces the background of agreement on rules of origin, which mainly discusses the development of"Protocol of agreement on rules of origin"and"Provisions for the Implementation of the Rules of Origin in the People's Republic of China". The second part first introduces the details and background of the case and analyse the dispute of both sides, then discuss the key law issues of the dispute. At the beginning of the third part is the analysis of what EU do to utilize the rules of origin, followed by the pursue of"Measures"established by Chinese government in the angle of agreement on rules of origin. At the meantime,"Protocol of agreement on rules of origin"confirms the utilization of"Measures". In the last part, the author puts forward some shortcomings of the utilization of agreement on rules of origin and wishes those to be settled by the authorities. So that we can easily cope with the difficulties.
