Recycling Economy Law And Its Adjustment Methods

According to the investigation on Shandong Longli Technology Company, Jinan Steel Corporation and the regulations of Qingdao recycling economy, this paper begins with the problems about recycling economy and do some research about recycling economy law. The United states, Germany, Japan act as the representatives countries who develop recycling economy as the implement the strategy of sustainable development, through the introduction on these developed countries, this paper displays the legislative process of the recycling economy and phased achievements. From the original Energy Conservation Law to the later Environment Impact Assessment Law and Cleaner Production Improvement Law, moreover, the Promoting Recycling Economy Law promulgated in 2008, all the laws show the attention from the government and researchers, meanwhile, they points out the imperfect of the recycling economy law, as a result, we need to do more research on this problem.In order to legislate the recycling economy law, improve the recycling economy, there are two problems needed to be solved, the first is the understanding of the recycling economy law, only in this way can we make mature recycling economy law; the second is how to legislate mature recycling economy law and apply the law, and this is the aim the paper wants to research. On the basis of this, this paper elaborates the basic understanding on the recycling economy, from the universe airplane theory of American economist to the Plan of Qingdao Recycling Economy and the recent definition of recycling economy in Promoting Recycling Economy Law. This paper dissertate the whole understanding on the recycling economy which is the name for the saving, recycling in the process of production, transportation and consumption. The theory basis for this law is integrated and ordered, recycling, allelopathy, balance and self-regulation, and it follow the principles of Reducing quantity, Recycling and Resource. Recycling economy law is the regulation for the construction of recycling economy, by means of regulating the rights and obligations in the recycling economy process, the producing and living will be arranged following the recycling law. Therefore, we can achieve the society goal of harmonious, prevention, whole-process-control and apportionment of liability; finally we can reach the basic concepts of appreciating nature, compound system, optimization economy, clean production, and moderate consumption.This paper suggests that the definition of the basic recycling economy law should be included in the area of environmental law. This paper discusses the similarity and differences between the laws in the procedure of pollution and production, and then points out the character for it to be a whole system law, that is the law focuses on the harmonious between people and nature, pays attention to the trade off between environment protection and economy development, protects ecological environment.Finally, focusing on this special law, this paper discusses the special adjustment and then compares it with the adjustment of civil law and administrative law, as a result, this paper proposes three requirements for the adjustment of setting recycling economy law, they are setting the goal according to the recycling economy law, setting the whole system law, adjusting the methods according to the recycling economy law. Besides that, the paper focuses on the adjustment system which is obligatory, compulsory, promotive, and characterized by the development of economy.
