With the implementation of the general plan of running a country in accordance with the law of the Communist Party of China, the setting-up of the socialist market economy system and demand for socialist political civilization construction, if we keep an eye on current situation of our country governed by law and important role that government play among national politics, economy, and culture life, building the government governed by law becomes desirability of present form and future development. The Central Party Committee and the State Council of the Communist Party of China has put forward the goal which build the government governed by law within ten years in good time, and this is important embodiment of social development and progressive, and structuring the government governed by law becomes important subjects studied of scholars. Because our country lack historical tradition of rule by law," and reflect people's idea with governed by law is thin, and lose behavior standard among national each field in society lives, and low the ability and quality of the government manage the country, control the society with the law, and some other reason of reality, all of them become important problems which must be faced and solved while we build government under the rule of law. We must objectively analyze these questions and offer to consideration for measure, since these are impartment to build government under the rule of law.This dissertation centers the discussion on why and how to construct the rule-of-law government, taking the important subject of current Chinese constitutional construction- the rule-of-law government as its topic, setting people oriented as the concept of value and the profound spirit of rule-of-law government. Along the thinking route from abstract to concrete and again from concrete to abstract, firstly It discuss the general theories of the rule-of-law government and people oriented respectively, then probe into several important problems of constructing the rule-of-law government, including administrate power according to law. Converting the government function, make decision by law, etc. The correlations between the active and negative responsibility of the government are also be discussed by combining people-oriented and the government responsibility. The dissertation is composed of seven chapters, that are organized as one unified entity.Humanitarianism spirit based on the people oriented was creatively absorbed in the thesis as complementarities of administration by law. This is a kind of civilized administration method which is require the administration behavior obey the law, the procedure according to law, and both of behavior and procedure are conformity. Humanistic administration concerned with Humanitarianism spirit which is giving good people deep consideration and protecting the criminal's basic humanistic rights. Humanistic administration is not to weaken the principle of law, but to conjoint the law and Humanitarianism spirit together to further improve the law's function on government administration.
