Study On Issue And Countermeasure Of The Election Of Village Committee

Village self-governance in China's history for the first time has been realized through the form of direct democracy in of rural grassroots, which not only meet Chinese farmers' strong desire of the masters of their own destiny for thousands of years, but also has an important significance in the building of socialist democracy. Since 1983, policy of village committee elected by villagers directly has been promoted in nationwide. The improvement in village election is obvious to all, from candidates being designated at first to current direct election. The author has concerned with the sixth election of village committee in Hunan as a normal worker of Hunan Administration office of uniformity and dignity of the socialist legal system. Therefore, the author would introduce of the election of village committee and try to find some way to solve the problem of the election of village committee.For further study, the paper discusses the position of village election, system architecture, basic rules and instructive theories involved, which make the theory foundation for paper writing. The dissertation would like to discuss the background of history or era, the discussing significance of the sixth election of village committee in Hunan. Using the method which is the association of "process and matter" or "relation and matter", the paper emphatically analyzes all circles of the sixth election of village committee in Hunan and find problems with typical significance such as the illegitimacy in electoral procedure, bribery in election, excessive intervention from villages and towns' government which influence fairness and quality of the election, the contradiction between the branch of the Chinese Communist Part and Village committee, the absence of the effective legal protection and relief's mechanism, apathy from villagers for the election and so on. Reasons are explored. Without solving these problems, further development of village election will be hindered. In ordered to reform and perfect the election in Hunan, using relative instructive theories from the point of taking measures both from its root cause and symptoms base at present while looking forward to future, the thesis puts up suggestions like enhancing legislation system, adjusting administrative relationship and improve election environment to provide the academic and practical reference of the election for Hunan or extending to the whole country, which will promote advancement of our nation's village committee election into democratic, healthy and legal directions and help village committee election blooms beautifully and bears rich fruits.
