A Study On Student Crime In The Higher Vocational Colleges

There are more than 1000 higher vocational and technical colleges which are independently established in our country, taking up more than half of nationwide institutes of higher learning, and nearly 8 million at-school students of vocational schools, taking up more than half of at-school students of nationwide institutes of higher learning, which is commonly referred to as half of country. Under the circumstance that institutes of higher learning expand enrolling scale of new students in succession, a considerable portion of students recruited by higher vocational colleges are inferiors in quality of culture, ideological cultivation and morality, inadequate in self-confidence and weak in capability of self-control and self-discipline, what's worse, a minority of schools even recruit students of criminal record, and there are a lot of deficiencies in educational and managerial mode of higher vocational college. For the past few years, the number of students who commit crime in higher vocational college is in an increasing trend, and the type is inclined to diversification, however, researches on crime of higher vocational college students are relatively in a lack. It has great significance to attach importance to crime situation of higher vocational college students, and to put forward train of thought, measure and countermeasure to prevent and reduce illegal crime of at-school students. Because illegal crime of higher vocational college students influences important social benefits of individual, family, society and country etc., we must keep away actively, and strive to reduce injuria and crime of higher vocational college students. The author conducts survey, classification, arrangement and study of cases of crime of higher vocational college students in connection with recent situation, analyzes its characteristic and reason, and seeks way of preventing crime of higher vocational college students.This thesis is divided into 4 parts. In part-1, based on referring to Criminal Law theory and crime theory and the starting point in favor of preventing crime, the author, in the first place, makes a summary of nature of crime of higher vocational college students, and advices to recognize problem of crime of higher vocational college students in an angle of broad crime theory, which should include 2 aspects: injuria of higher vocational college students and crime of higher vocational college students. Therefore, crime of higher vocational college students is defined as behavior of students, who receive higher education of vocational technique, to break Criminal Law, and punishing law of managing public security. This thesis continues to analyze characteristic and developing trend of crime of higher vocational college students. Its main characteristics are: the violated object should give priority to property benefit, type of crime is diversified; there are many accidental causes for crime of higher vocational college students; crime proportion of female students in higher vocational college increases; society and family pay little attention to higher vocational college students. The development trend in future is: illegal crime is inclined to collectivization; the trend of high-intelligentization is increasingly obvious; illegal crime of property-invasion continues to take primacy and crime cases caused by exceptional psychology still take up a considerable proportion.Part-2 refers to main types of crime of higher vocational college students. In this part, the author makes arrangement and analysis of hackneyed types of crime of higher vocational college students, which primarily registers as crime of property, crime of violence and crime of sex. Firstly, crime of property, the floorboard of all kinds of crimes with regard to breaking property relationship, refers to a certain behavior to possess or devastate public and private property by illegal means. In property crime of higher vocational college students, crime of stealth and crime of fraud are comparatively obvious. Crime of stealth, committed by higher vocational college students, contains roughly several types as follows: ignorant type, in-passing type, meticulously-plotted type and inside-and-outside collusion type. Crime of fraud, committed by higher vocational college students, mainly concludes the following types: fraud of short message and telephone; network fraud. Next, hackneyed crime of violence of higher vocational college students mainly refers to voluntary injury, voluntary manslaughter, robbery, rape etc., among which voluntary injury and robbery are focally analyzed in this thesis due to the highest possibility to occur. By analysis, the author finds that voluntary injury of higher vocational college students shows several characteristics: outburst and sentiment. And characteristics of robbery are: the crime subject often has unhealthy fondness, the crime behavior is durative and premeditated, and the crime mean is merciless. Finally, behavior of sex crime of higher vocational college students is sorted out as follows: disseminating obscene materials; prostitution; retaliation and voluntary injury caused by illegal sex.Part-3 refers to analysis of crime reason of higher vocational college students. In this part, the author introduces psychological characteristics of crime of higher vocational college students and makes brief analysis. Sentimental characteristics of crime of higher vocational college students take on as follows: insufficient social emotion, unhealthy trend of passive affection, coexistent self-pride and self-undervaluation and accidental sentiment. Meanwhile, a majority of higher vocational college students are in low spirit. Then, the author analyzes crime reasons of higher vocational college students in every aspect. The first is social reason, which includes influence of downside effect of social economy and influence of unhealthy social culture. The next is juvenile psychology of higher vocational college students, which is mainly shown as the following aspects: weak psychology, incapable of responding to setback; confused psychology, uncontrolled sentiment; dissatisfaction to society, strong retaliation; unhealthy psychology of sex. The final is institutional reason, which contains defective educational system of schools; lagged managerial system and inadequate managerial strength.Part-4 refers to protective measures against crime of higher vocational college students. In order to reach the aim to prevent crime of higher vocational college students, society, school, family and individual university student need to make great effort in many ways. This thesis primarily constructs protective system in 3 aspects; the first is social prevention, whose measures take on as follows: the society should help higher vocational college students to correct unhealthy philosophy, sense of worth and world point of outlook; favorable psychological education should be launched in society; education of legal system and institutions should be developed and comprehensive social treatment should be strengthened in society, comprehensive treatment system of society--institute of higher learning should be built. The second is school prevention, whose specific measures include: fostering sense of legal system and institutions of counselors to take favorable guiding effect; strengthening dignity and mental health education of students, and envisaging illegal crime; cultivating law consciousness of higher vocational college students; reinforcing managerial work of higher vocational college; strengthening contact with family of students to understand them in overall. The last is family prevention, whose primary measures are: improving way of family education; raising self-essence of parents; building harmonious family environment.
