Research On Legal Countermeasures Of Green Trade Barrier

Under the drive of international economic integration, the international markets are competing gradually and dramatically.The trade frictions are coming about continuously, during which the green barrier is emerging as one of new type of non-tariff barriers. The green trade barrier plays a positive role in protecting the environment, but it also hinders the formation of the international free trade, which is so-called dual property of the green trade barrier. As a newly-emergencing trade protection measure, the green barrier is playing an increasingly important part in the international economy day after day. The green trade barrier what we infringed regularly is about both discrimination and unequality to the developing countries. We must solve the problem of the green trade barrier to promote exports trading development in order, for particularly recently we have suffered from the green trade barrier in the international trade increasingly. So we have no choices, but we have to meet with it, and the right contingency measures of the green trade barrier, will have a direct impact on the economic development of the related industries. This article will analyze the concept and the characteristics of the green trade barrier as a start, illustrate its existence and basis from law and economy in the second part, summarize the dual effect of the green trade barrier to our country's economy and environment. At last, I will give some suggestions for legal countermeasures of green trade barrier from the domestic and international trades combined the study of some real cases.
