Realistic Analysis On Law And Petition In Gansu Province

Under the backdrop of the high Incidence of nationwide petition cases,law and petition run highly year by year which has become focus of society and news media. Although law and petition have played an important role in resolving social disputes and the relief of petitioner's rights, it must be noted that it has become one of the main factors on effecting Chinese social stability and development because of a variety of reasons.With a strong sense of social responsibility, the developmental process of Chinese petition system and the backdrop of law and petition are reviewed. On the basis of that discussed above, paper analyses the status and characteristics of law and petition in Gansu Province meanwhile causes are explored. Then some practicable tracks resolving social disputes, preventing law and petition, resolving present law and petition efficiently are proposed. That has important practical significance in vindicating the stability and development in Gansu Province.This paper is structured as follows:The introduction briefly describes the background and significance of this paper and the research ideas and methods.Chapter one first defines the concept of law and petition on the basis of nature, role and functions, and then reviews development of law and petition in our country.Chapter two analyses the status and features of the national law and petition. Using that as the background, paper describes status and features of the law and petition in Gansu province by empirical analysis methods.Chapter three first analyses the problems existing in the law and petition in Gansu Province, and then sums up the social and political impact of the law and petitions.Basic ideas such as the law and petitions can weaken judicial authority, reduce the government's credibility, and enhance economic cost of "the right" relief are bring forwarded.Chapter four discusses the causes of law and petitions from the aspects of the socio-economic environment, political and legal authorities, and the petitioner in Gansu Province.Based on the analysis above, Chapter five raises realistic solution about law and petitions in Gansu Province in many ways.
